Important: By accessing or using Bismel1, you agree to these Terms of Use. If you do not agree, do not use the platform.

1. Acceptance of Terms

These Terms of Use govern your access to and use of Bismel1, including its website, customer dashboard, trading automation tools, product pages, account tools, broker connection features, runtime monitoring, alerts, reports, and related services. Bismel1 is operated by Gusgraph LLC.

By creating an account, accessing the platform, connecting a broker account, using a trial, purchasing a product, accepting an invite, or otherwise using Bismel1, you agree to be bound by these Terms and by the Bismel1 Privacy Policy.

Bismel1 may update these Terms from time to time. When material changes are made, Bismel1 may provide notice by email, dashboard notice, website notice, or another reasonable method. Continued use of Bismel1 after changes become effective means you accept the updated Terms.

2. Platform License

Subject to these Terms, Bismel1 grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the platform for your own lawful trading workflow and account-management purposes.

This license does not transfer ownership of Bismel1, its software, design, strategy logic, trade automation systems, dashboards, documentation, reports, branding, or intellectual property.

3. Eligibility and Account Responsibility

You must be at least 18 years old to use Bismel1. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate account information and keep it current. You must promptly notify Bismel1 if you believe your account has been accessed without authorization.

You are responsible for your own broker account, broker approvals, account funding, market data permissions, trading permissions, and compliance with any broker terms that apply to your use.

4. Product Access and Entitlements

Bismel1 may offer multiple products, plans, subscriptions, trials, add-ons, and invite-based access levels. Product access may include, depending on your entitlement: B1 Execution, Prime Stocks Bot Trader, demo or trial access, broker connection features, paper trading automation, live trading automation, runtime monitoring, reports, positions, orders, activity views, add-ons, or custom strategy services.

Access may be limited by plan, product, account, broker connection, subscription status, trial status, verification status, or administrative approval.

Trial or demo access may allow read-only platform preview and demo data access. Unless expressly stated, trial/demo access does not include broker connection, paper trading, live trading, runtime automation, order placement, strategy editing, or customer-owned trading execution.

5. Broker Connection and Trading Automation

Bismel1 may connect to supported third-party broker services through approved integration methods. When you connect a broker account, you authorize Bismel1 to interact with that broker account only within the scope of the access, product, and permissions you enable.

Broker services are third-party services. Bismel1 does not control broker availability, execution quality, market data availability, order routing, fills, account approvals, margin eligibility, short-selling availability, trading restrictions, or broker-side errors.

You are responsible for reviewing your broker account, positions, orders, account settings, buying power, margin status, fees, and trading permissions.

6. No Investment Advice

Bismel1 is a software platform and trading automation tool. Bismel1 does not provide investment advice, financial advice, tax advice, legal advice, brokerage services, portfolio management, or individualized recommendations.

Any data, alerts, signals, strategy output, automation result, dashboard item, runtime status, report, or AI-assisted context is provided for software and workflow purposes only. You remain solely responsible for deciding whether to enable, disable, configure, use, or rely on any automation or trading feature.

Bismel1 does not guarantee profits, trading success, market performance, reduced losses, or any investment outcome.

7. Trading Risk

Trading stocks, ETFs, options, crypto, or other financial instruments involves substantial risk. Markets can move quickly and unpredictably. You may lose money, including all or a significant portion of the funds in your broker account.

Automated trading may create additional risk, including risks from market volatility, data delays, broker outages, software errors, configuration mistakes, internet failures, third-party service failures, stale market data, duplicate or rejected orders, unexpected fills, and user misunderstanding.

You agree that all trading decisions and trading results are your responsibility.

8. User Configuration and Instructions

You are responsible for any settings, symbols, strategies, risk controls, broker connections, account selections, product selections, automation toggles, and other instructions you configure in Bismel1.

Bismel1 may provide default settings, guardrails, runtime monitoring, and automation controls, but those features do not remove your responsibility to review and understand your own account and trading activity.

9. Prohibited Use

You agree not to misuse, copy, resell, sublicense, rent, or commercially exploit Bismel1 without written permission; attempt to reverse engineer, decompile, scrape, or extract platform code, strategy logic, data, or proprietary systems; interfere with servers, APIs, security controls, runtime systems, or broker integrations; use unauthorized bots, scraping tools, load testing tools, or automated extraction systems; create false identities or use another person’s account without permission; use Bismel1 where doing so is illegal or violates broker rules, market rules, sanctions, or applicable law; submit false, misleading, harmful, unlawful, or infringing content; or attempt to bypass entitlements, trial limits, access restrictions, broker limits, runtime permissions, or security controls.

10. Intellectual Property

Bismel1, Gusgraph LLC, the Bismel1 name, platform design, software, product structure, strategy systems, runtime logic, dashboards, content, text, visuals, logos, documentation, and related technology are owned by Gusgraph LLC or its licensors.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Bismel1 or its proprietary materials except as expressly permitted in writing.

Feedback, suggestions, ideas, or improvement requests you provide may be used by Gusgraph LLC without restriction or compensation, unless otherwise agreed in writing.

11. Third-Party Services

Bismel1 may use or integrate with third-party services, including broker services, cloud services, payment processors, data providers, email services, AI providers, and analytics or infrastructure providers.

Third-party services are governed by their own terms and privacy policies. Bismel1 is not responsible for third-party service failures, outages, data delays, restrictions, decisions, or policy changes.

12. Payments, Subscriptions, Trials, and Access Changes

Paid products may be billed through third-party payment processors. Subscription terms, renewal periods, trial periods, cancellation options, refunds, and access limits may vary by plan or offer.

Failure to pay, cancellation, expiration, chargeback, trial expiration, access revocation, or loss of eligibility may result in suspension or termination of product access.

Bismel1 may offer promotional, affiliate, invite-based, demo, or administrative access at its discretion. Such access may be limited, revoked, expire, or differ from standard paid access.

13. Data, Reports, and Runtime Monitoring

Bismel1 may display market data, account data, performance metrics, runtime health, positions, orders, activity, broker state, strategy output, and system status. These displays may be delayed, cached, incomplete, inaccurate, or affected by third-party data and broker systems.

Runtime monitoring is designed to improve transparency and system visibility, but it is not a guarantee that every issue will be detected or prevented.

You should review your broker account directly for official account, order, position, and balance information.

14. Availability and Changes

Bismel1 may change, suspend, update, limit, or discontinue any feature, product, strategy, page, integration, report, runtime system, plan, pricing, or access mode at any time.

Bismel1 does not guarantee uninterrupted availability, error-free operation, perfect market data, uninterrupted automation, or continuous broker connectivity.

15. Disclaimers

Bismel1 is provided “as is” and “as available.” To the maximum extent permitted by law, Gusgraph LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and error-free operation.

Bismel1 does not guarantee profits, returns, trading success, signal accuracy, order execution, market data accuracy, or any financial result.

16. Limitation of Liability

To the maximum extent permitted by law, Gusgraph LLC, its owners, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, trading losses, lost data, business interruption, loss of goodwill, or lost opportunities.

To the maximum extent permitted by law, the total liability of Gusgraph LLC for any claim arising out of or relating to Bismel1 or these Terms will not exceed the amount you paid to Bismel1 during the three months before the event giving rise to the claim, or $100, whichever is greater.

17. Indemnification

You agree to defend, indemnify, and hold harmless Gusgraph LLC and its owners, officers, employees, contractors, affiliates, service providers, and licensors from any claims, damages, losses, costs, liabilities, and expenses, including reasonable attorneys’ fees, arising from or related to your use of Bismel1, your broker account activity, your trading decisions, your violation of these Terms, your violation of law, or your infringement of any third-party rights.

18. Suspension and Termination

Bismel1 may suspend or terminate your access at any time if you violate these Terms, create risk for the platform, misuse the service, fail to pay, lose eligibility, violate broker or market rules, or if continued access would create legal, security, operational, or compliance risk.

After termination, provisions that by their nature should survive will remain in effect, including ownership, disclaimers, limitation of liability, indemnification, dispute terms, and general provisions.

19. Dispute Resolution

Any dispute arising out of or relating to these Terms or Bismel1 should first be addressed by contacting Gusgraph LLC at the support contact listed on the website.

If a dispute cannot be resolved informally, the parties may be required to resolve the dispute through binding individual arbitration, unless applicable law requires otherwise or the claim qualifies for small claims court.

Class actions, class arbitration, and representative actions are waived to the maximum extent permitted by law.

20. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, unless another governing law is required by applicable law.

21. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Bismel1’s failure to enforce a provision is not a waiver of future enforcement.

You may not assign these Terms without written permission from Gusgraph LLC. Gusgraph LLC may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or business transfer.

These Terms, together with the Privacy Policy and any applicable product or subscription terms, are the entire agreement between you and Gusgraph LLC regarding your use of Bismel1.
